I have troubles with setting reasonable deadlines for myself/overestimating the amount of work I can do per day/week and underestimating the amount of time I need to rest. I'm trying to do better in managing but keep it in mind. I'm really sorry for any inconveniences and delays. Please, don't take a commission if you have an urgency.I left my country by political reasons and my life had some interesting turns, so now I'm in a big art debt (figuring it out the best I can) and still drawing is the only thing that I can do for living in that circumstances, thats why I keep taking new commissions.
The execution deadlines are very increased at the moment, for which I apologize in advance and ask you to understand this.
I advise you to claim a spot only if you want to help / you are able to wait 12+ months. Otherwise, I recommend waiting until I sort out the situation.

I. GENERAL DISCLAIMERS
.
0.1. The parties and important objects related to the TOS can be further mentioned as:
...0.1.1. (Potential) customer (as "Customer", "You", "Client")

....0.1.3. Commission (as "media", "order", "artwork")
....0.1.4. Third party (p.4.5.) (read as "my husband, skilled tattoo artist with big heart and will to help me with routine work" c: )

1.1. I preserve the right to refuse or discontinue a commission at any time with or without explanation. ( look p. II.REFUNDS )

1.2. Disrespectful behavior will not be tolerated and I reserve the right to cancel your commission if it occurs.

1.3. I preserve the right to overlook some of the rules described in my T.O.S. in favor of the client's interests, and I'm responsible for every decision on ignoring my T.O.S. made by me.
.
1.4.1. I have the right to overlook and change some of the parts of my T.O.S.
...1.4.2. The client is obliged to follow only the version of T.O.S. they agreed with.

1.5. A client automatically agrees to the following Terms of Service by sending me the requested payment for the commission.

II. PAYMENTS & FEES
.
2.1.1. Payment for my work is due in full upfront.
....2.1.2. All the prices in a price list are not exact prices for each commission. The final price on your exact commission depends on many factors and can be changed in a process of fulfillment if you as a commissioner make a decision to add and/or change something in the process of fulfillment.
....2.1.3. In some cases some fees can be added for addittional details,which is described in my price list. (look p. 2.4.)
....2.1.4. The actual pricelist shows the approximate cost of each type of media with all the rights for commercial and non-commercial usage by me as an artist. (look p. VI.)
....2.1.5. In case of disagreement on the part of the client with some of the ways of usage the media they commissioning, the client should ask for the "private terms", which can require addittional fee.

2.2. All the payments are done via PayPal invoice using USD, Euro (at an approximate exchange rate for the date when invoice will be created.)
.
2.3. Payment plan is available with commissions which price is more than 500 USD.
....2.3.1 In case of payment plan the payment can be divided on 2-4 different payments, where 1st payment is equal 50% of commission cost.
....2.3.2. In case of payment plan each payment covers some part of commission fulfillment, what will be discussed upfront.
....2.3.3. In a situation of cancellation of the commission in the middle of the fulfillment I reserve the right to not refund the payments for those stages of the work which is completed.
....2.3.4. In case of payment plan refunds are available only for the stages that can be considered as unfinished.
.
2.4. "Addittional fee" can be ranged from 1% of the total price of the commission.
....2.4.1. Each and every "addittional fee" connected to the service I can provide for the customer or special requirements of the clients.

III. REFUNDS
.
3.1 Refunds are available for the unfinished commission in some cases:
....3.1.1. I haven't started working on your order yet. In that case you'll have a full refund -Paypal tax, - 1% income tax I paid when recieved your payment.

....3.1.2. I started working on your order, and for the moment refund is requested I'm on a stage of Sketch/Lineart/Coloring. In that case I propose 50% refund (- Paypal tax), leaving the rest as a compensation for my time and effords.

3.2. On the stage of shading and render refunds are not available.
.
3.3. Every addittional fee will be revised and marked as "completed" or "incompleted", the refund is available only for those fees, which is considered "incompleted" as client did not recieved the service they asked and paid for.

3.4. The approximate due date for refund is 6 months if other due date wasn't discussed with me.

IV. GENERAL INFORMATION ABOUT COMMISSIONS
.
4.1. The list of availavle options for commissions contains different types of digital and/or physical media (illustration, comic, animation, social media sticker(s), character reference, etc.).
....4.1.1. Each type of media and its preferences (Such as size, file format, resolution etc.) supposed to be discussed separately.
....4.1.2. All the preferences for the commission described in 4.1.1. should be discussed with me ahead. Any changes in the middle of the work process may cause addittional fees.

4.2. Deadlines should be discussed upon prior to the start of the commission and may cause addittional fees.
....4.2.1. If no deadlines was setted, that means that the official due date for the commission is indefinite.
.
4.3. Optional size for any type of digital illustration/sketch starts from 1500x1500 pix (if no other info written in a price list) , resolution is 200-300 dpi.
....4.3.1. At the end you'll recieve a PNG, GIF, JPEG or other type of format file in a fullsize and addittional smaller WEB version with optional sizing and resolution 72 dpi.
....4.3.2. I reserve the right to not show and share the original files where all the process of my work is shown in details.

4.4. I reserve the right to stream the process of the commission fulfillment via Picarto platform, and ask the clients permission about it beforehand. If no disagreement has been demonstrated, this automatically means agreement on the part of the client.
.
4.5. I (artist) as an individual enterpreneur preserve the rights to resort to the help of third parties in commissions fulfillment.
....4.5.1. Each customer will be informed if their commission(s) which can require the help of the third parties. The information will contain the fact of the approximate third party in a commission fulfillment and the exact part of the work I partly delegate to provide more effective workflow.
....4.5.2. None of the impact on the commissions from the third parties will be unsupervised by me (artist).
....4.5.3. The stages of the work on the commissions I can delegate on the third parties cannot be the stages which shows my personal view, skill, style etc.
All the stages which can be delegated requires minimal skills and will be updated by me (artist).
....4.5.4. I guarantee the fact that in case of involving third parties in a commission fulfillment the quality of the media will be the same, as the quality I can provide by doing all the work myself. Any delegation of work only has the purpose to provide more effective workflow.
....4.5.5. Customers preserve the rights to disagree with involving third parties in their commission. This should be discussed before the payment and sometimes (!) can require and addittional fee.
.V. REVISIONS AND FEEDBACK
.
5.1. Commissioner has a right for revisions of my work in a process, to leave addittional information, ask for reasonable amount of changes and check on the commission fulfillment.
....5.1.1. In a process of fulfillment I can ask for addittional feedback to make sure that the client agrees with the way commission is going.
....5.1.2. Basic amount of revisions is 3 after each stage: 1. Rough sketch of the idea with simplified visual information about lighting and main objects placement; 2. Lineart&Flat color; 3. Finalization stage.

5.2. I reserve the right for adding a fee for addittional revisions if client asks for it.

VI. COPYRIGHT AND USE OF MEDIA CREATED BY ME6.1. I preserve all rights to every commissioned piece of media drawn by me, including all
author’s economic rights to the above-mentioned media (if other requirements did not discussed with the customer towards their commission)

....6.1.1. By commissioning me to draw a character a client has the rights to, the client
automatically allows me to use their character in the commissioned drawing. The client
also allows me to use the commissioned drawing containing their character for
commercial use such as selling prints of the commissioned drawing (unless other conditions are agreed before the start of work).
....6.1.2. Client has the right for non-comercial use the commission they paid for.
....6.1.3. If there's a question about commercial usage of the media (commission) made by me on the part of the client - It should be discussed and some decision should be made before I start the commission.
....6.1.4. Any commercial/non comercial usage of media made by me without my direct permission is prohibited.

1) Put as much information as you can in ONE big message:
- Type of the piece you want (price list should help with it!)
- References (your refs and maybe references from my gallery)
- Options (if you have several ideas you want equally)
- Addittional info (if your References are not 100% correct - explain it trough text! Feel free to add as much info as you want!)
- Your PayPal (at that point just to not search it trough the chat later)
- Privacy preferences (no posting, no streaming, no mentioning etc. Sometimes I can add some fee for that, but usually Im okay)2) When everything is cleared - I send you an Invoice/ you send the payment trough the PayPal button and I add you to my waiting list and note you when I start your piece.3) I provide 2-3 reviews during the progress where We discuss the details and changes. Usually we discuss the amount of available changes in the process4) When the piece is done - I send it to you via Email/Telegram in full res...............................................................................................ADDITIONAL INFO:Waiting list- In some cases, I can offer you a replacement composition, idea, color scheme, if I have a heavy artblock and the execution of the order may lead to a loss of quality.
- Sometimes I have severe artblocks due to mental health problems, I'm trying to manage it as good as I can, but keep that in mind. In any case I'm doing my best at any point of life to meet your needs as a customer.
